General terms and conditions
The real estate company Euroset, s.r.o. , registered in the commercial register of the District Court in Prešov in the Sro section, insert number 35427/P (hereinafter referred to as the "real estate agency") is a legal entity that, as part of its business activity, deals with the mediation of the purchase, sale and rental of real estate . In order to achieve continuous improvement of the services provided, the real estate agency has adopted these general terms and conditions, which establish the rules for the activities of the real estate agency in mediating the purchase, sale and rental of real estate, so that the real estate agency, based on the client's instructions and exercising professional care, carries out activities aimed at achieving the maximum satisfaction of its clients. clients as well as those interested in buying, selling or renting real estate.
The real estate agency is properly registered with the Office for the Protection of Personal Data of the Slovak Republic and has developed a security project for the protection of personal data of clients for the purposes of Act no. 136/2014 Coll. on the protection of personal data. Furthermore, it has developed a program of its own activities aimed at combating the legalization of income from criminal activity and the financing of terrorism.
Legal relationship between the real estate agency and the client
The real estate agency performs mediation activities for a client who expresses an interest in mediating the purchase, sale or rental of real estate (hereinafter referred to as the "property owner") on the basis of a mediation agreement.
The mediation agreement is concluded in accordance with the provisions of § 262 of Act no. 513/1991 Coll. of the Commercial Code, as amended, and regulates the mutual rights and obligations of the contracting parties (hereinafter referred to as the "intermediary contract").
The rights and obligations of the contracting parties from the brokerage contract , which are not expressly regulated in the brokerage contract, are governed by the provisions of the relevant legal regulations.
The real estate office carries out brokerage activities with professional care in accordance with the provisions of the brokerage contract as well as in accordance with the relevant legal regulations.
With the brokerage contract, the real estate agency undertakes to procure, with professional care, for the property owner, for a fee , the conclusion of a purchase or rental contract for the property specified in this contract, with the aim of achieving maximum client satisfaction.
Inspection
If the real estate owner expresses an interest in mediating the sale or lease of the real estate he owns, the real estate agency will inspect it when signing the brokerage contract.
During the inspection of the property - recruitment of the property to the offer of the real estate agency, the client will be informed of the essential rules for securing the sale of the real estate through the real estate agency.
When inspecting the real estate, the real estate agency will make a record of the inspection, which includes in particular the specification of the real estate, the location and area of the real estate, a description of individual parts of the real estate, a description of the accessories of the real estate, a description of the identified deficiencies or defects found during the inspection, the price for the sold property, the amount of the commission of the real estate agency, etc.
The real estate agency always performs the inspection in cooperation with the property owner and in his presence.
The real estate agency will carry out photographic documentation of the property when taking over the property. All published photos, floor plans, and texts are the property of the company and cannot be copied without the written consent of the company. The price for a violation for one property is fixed at EUR 500 (for each) and in the event that no agreement is reached, it will be enforced by a lawyer.
Professional care
The real estate agency performs intermediary activities for the property owner aimed at concluding a purchase contract or rental contract with professional care.
As part of professional care, the real estate agency will verify the existence of the property right of the person who is the seller of the property or the lessor of the property, especially from the relevant title deed.
The real estate agency will check the existence of liens such as liens or encumbrances attached to the property that is the subject of mediation.
If the real estate agency's client is a person interested in buying real estate, the real estate agency will notify the client of the existence of liens tied to the property as soon as it becomes aware of this fact; in the event that the real estate agency is already aware of this fact when concluding the brokerage contract with the client, the real estate agency will inform the client of the existence of tiarchs already at the time of signing this brokerage contract.
The real estate agency will check the technical condition of the property , which is the subject of mediation, and in particular whether the property has any legal or factual defects.
In the event that a client of a real estate agency is interested in purchasing real estate, and if the real estate agency discovers the existence of legal or factual defects in the real estate, it will notify this fact as soon as it becomes aware of this fact; in the event that the real estate agency is already aware of this fact when concluding the brokerage contract with the client, the real estate agency will inform the client of the existence of defects as soon as this brokerage contract is signed.
Posting an offer
The real estate agency publishes offers for the sale , purchase or lease of real estate in electronic and printed media of its choice as part of its mediation activities.
As part of the publication of an offer for the sale, purchase or lease of real estate, the real estate agency shall publish the specification of the real estate in printed or electronic media, in particular the location, area of the real estate, its division and a brief description of the individual parts of the real estate; the real estate agency, at its own discretion, will also publish a visual representation of the property as part of the offer for sale, purchase or rental of real estate.
The real estate agency will ensure repeated publication of the offer for sale, purchase or lease of real estate so that the offer of the real estate agency is made as accessible as possible among the offers of competing real estate agencies to a potential applicant for the conclusion of a purchase or lease agreement, the subject of which is the real estate advertised as part of the offer for sale, purchase or real estate rental.
If there is a change in the data contained in the offer for sale, purchase or lease of real estate, the real estate agency shall ensure that this data contained in the offer for sale, purchase or lease of real estate is updated without undue delay after learning about the change in data.
When publishing data published as part of an offer to sell, buy or rent real estate, and especially when publishing image documentation of the real estate, the real estate agency ensures that the privacy of the real estate owner is not violated by publishing this data.
The real estate agency bears the costs associated with advertising offers for the sale, purchase or rental of real estate.
Inspection and reservation
The real estate agency will provide access to the property for the purpose of inspection for the interested party who expresses interest in concluding a purchase or lease agreement for the property offered by the real estate agency.
Access to the property will be provided by the real estate agency after agreement with the property owner, as well as with the person interested in buying or renting the property.
The real estate agency shall ensure that no damage is caused to the real estate during the inspection towards its clients who are the owners of real estate whose sale or lease the real estate agency mediates.
If the person interested in buying the property is seriously interested, it is possible to reserve the property and not sell it further until the signing of the purchase contract, if the person interested in the purchase deposits a reservation deposit in the real estate agency.
In the event that the person interested in buying the property is not willing to pay the full amount of the reservation deposit at the real estate agency, the property for sale will continue to be advertised until the applicant pays the entire reservation deposit.
Reward
The real estate agency is entitled to a reward only on the day of signing the purchase contract or rental agreement, the conclusion of which is the subject of an intermediary agreement concluded between the real estate agency and the client.
The specific amount of the real estate agency's remuneration is individually agreed within the Intermediary Agreement concluded between the real estate agency and the client, depending on the price of the property being sold.
A person interested in buying a property can pay the reservation deposit by non-cash payment to the account of the real estate agency or in cash, while the reservation deposit is included in the purchase price of the property specified in the purchase contract.
The real estate agency is entitled to a fee for a period of one year, even on the condition that the conclusion of the purchase contract or lease agreement, the conclusion of which was the subject of the mediation agreement, took place after the expiration of this mediation agreement, if the conclusion of the purchase agreement or lease agreement took place in direct related to the activity of the real estate agency.
The real estate agency is entitled to a fee even if the client concludes a purchase contract (or other alienation contract) or a lease agreement with a third party, whom the real estate agency has identified as a person suitable for concluding a purchase contract or a rental contract, without further cooperation of the real estate agency (e.g. .by inspecting the property with a designated person).
Final provisions
The real estate office confirms that the personal data of its clients, which are in accordance with Act no. 428/2002 Coll. protected will be used only with their consent to fulfill the purpose of contracts related to the purchase and sale of real estate, otherwise they are confidential.
Any proposal leading to the conclusion of a contract with the buyer that meets the requirements of the property owner, the intermediary is obliged to discuss with the property owner without delay.
For the needs of the real estate owner and those interested in purchasing real estate, the broker undertakes to keep all documents and copies of purchase contracts acquired in connection with his activity.
